Terms of Service

Customer has accepted and shall be bound by all the terms and conditions set forth in this Agreement by any of the following:

• Providing Klick Networks with a written or electronic signature on a service order.
• Ordering or requesting Klick Networks service by phone, through the website, or by other written or electronic communication.
• Submitting a deposit, installation payment, or other payment toward service.
• Activating and/or using internet service through the Equipment.
• Paying a Klick Networks invoice.
• Utilizing the web portal for one-time or recurring credit card payment.

Checks returned for any reason will be subject to a returned check fee. In the event of collection activities for non-payment, the Customer may be liable for a 20% collection fee in addition to the original amount owed. Past-due invoices may be charged a late fee after the due date.

In the event Klick Networks must use legal means for collection of past due amounts, the Customer will be liable for all legal and filing fees when any award is in favor of Klick Networks, LLC. In the event any loss of service is found to be the fault of the Customer or Customer-owned Equipment, an hourly troubleshooting fee may be charged.

The term of this Agreement is set forth on the service order and will be month-to-month unless otherwise indicated. This Agreement shall automatically renew on a month-to-month basis until terminated by either Klick Networks or Customer upon thirty (30) days prior written notice, an email to support@klicknetworks.com, or a ticket submitted via the Customer portal at portal.klicknetworks.com.

Annual Prepaid Plans: Customers who prepay for 12 months of service at the annual promotional rate receive 12 months of service for the price of 11. The promotional credit is applied to the 12th month of the service term. Annual prepaid plans are a 12-month commitment and are not eligible for the standard month-to-month cancellation-without-fee option during the annual term. Annual prepay discounts are non-refundable except where required by law.

Annual prepaid plans automatically renew for an additional 12-month term on the customer's anniversary date unless the customer notifies Klick Networks prior to the renewal date that they do not wish to renew.

Customer warrants that they are at least 18 years of age and either own the premises or have received written permission from the owner to make any changes needed to install and receive the service. Customer authorizes Klick Networks or its contractor to install the Equipment necessary to receive the service and agrees to allow access to the premises.

The Equipment supplied by Klick Networks under this Agreement is and shall remain the exclusive property of Klick Networks and must be returned in good and working condition upon termination, expiration, or disconnection of service. Equipment not returned within 15 days may result in a charge of up to $900.

Site Conditions and Underground Utilities: Customer acknowledges that installation may involve digging and other activities that could disturb the ground. Klick Networks is not liable for accidental damage to subsurface structures including irrigation lines, unmarked power lines, sprinkler systems, septic lines, drainage lines, or other buried features unless caused by gross negligence or willful misconduct. Customer is solely responsible for identifying and marking all private underground lines or utilities prior to installation. Klick Networks will submit locate requests through the 811 locate ticket system for public utilities, such as PUD, water, and telephone lines. Customer acknowledges that underground installation may disturb lawns, landscaping, plants, irrigation areas, driveways, or other surface features. Klick Networks will make commercially reasonable efforts to backfill and compact disturbed areas, but is not responsible for restoring grass, plants, landscaping, or other surface conditions to their prior condition unless damage is caused by gross negligence or willful misconduct.

From time to time, Klick-Net may offer promotional installation terms, including reduced-cost or free standard installation. If Customer receives a promotional installation discount or waiver, Customer agrees to maintain active Klick-Net internet service at the installed location for at least twelve (12) consecutive months from the service activation date.

If Customer cancels service, disconnects service, or otherwise terminates the account before completing the initial twelve (12) month service period, Klick-Net may invoice Customer for the standard installation charge that was waived or discounted as part of the promotional offer. The applicable installation charge will be disclosed to Customer at the time of signup or installation.

This provision does not create a fixed-term service contract. Customer remains on month-to-month service and may cancel at any time, subject only to repayment of any promotional installation discount or waiver if service is cancelled within the first twelve (12) months.

Upon cancellation, the Customer may opt to have a Klick Networks technician remove the Equipment, or the Customer may return it in proper working condition to the address on the most recent invoice. Equipment not returned within 15 days following cancellation may be repossessed or charged at replacement value.

The Equipment supplied by Klick Networks under this Agreement is and shall remain the exclusive property of Klick Networks and must be returned in good and working condition upon termination, expiration, or disconnection of service. Equipment not returned within 15 days may result in a charge of up to $900.

This entire Agreement shall be governed by the laws of the State of Washington. The venue for any dispute shall be in a District Court for the Counties of service.

Customer agrees to pay for Service monthly in advance by pre-authorized automatic charge to a valid credit or debit card or ACH eCheck bank payment. All invoices shall be due upon receipt.

If Customer fails to pay an amount when due, Klick Networks may charge a late fee of 18% of the amount due. If Customer fails to pay by the due date, Klick Networks may suspend service without notice. Restarting suspended service requires payment of all amounts due plus a re-activation fee.

You must use the service in accordance with all federal, state, and local laws, ordinances, and regulations. Klick Networks strongly recommends protecting all devices connected to the Internet with firewalls and up-to-date virus protection software.

Customer may not use the service or Equipment for any unlawful purpose or in any manner that could damage, disable, overburden or impair the Klick Networks network. Prohibited activities include but are not limited to:

• Attempting to gain unauthorized access to data, accounts, servers, or networks.
• Interfering with service to any user, host, or network.
• Forging or falsifying TCP-IP packet headers or sender/recipient identity.
• Transmitting threatening, abusive, libelous, defamatory, or obscene content.
• Sending unsolicited bulk email (spam).
• Distributing viruses, malware, or other harmful software.

KLICK NETWORKS DISCLAIMS, TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALL WARRANTIES, REPRESENTATIONS OR OTHER ENDORSEMENTS, EXPRESS OR IMPLIED, INCLUDING ALL WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR USE. IN NO EVENT SHALL KLICK NETWORKS BE LIABLE FOR ANY SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES ASSOCIATED WITH OR ARISING FROM USE OF THIS SERVICE, INCLUDING ANY LOSS OF USE, DATA OR PROFITS.

The fiber and wireless networks operated by Klick Networks are highly reliable and continuously monitored. However, extreme events outside the control of Klick Networks — such as lightning strikes, severe weather, and downed trees — can damage Equipment and affect service quality. Klick Networks delivers internet service directly to your home or business, but we rely on a larger carrier to connect our local network to the broader internet; that carrier is our upstream provider. Outages or repairs affecting our upstream provider are outside the control of Klick Networks and excluded from any service level commitments.

Internet Speeds: Customer understands and acknowledges that the advertised internet speed represents the maximum speed Customer may receive under these Terms. Customer understands and acknowledges that internet speeds are not guaranteed in any way. Many factors affect internet speeds; some are within the control of an internet service provider, but many are outside the control of Klick Networks.

Klick Networks will provide thirty (30) days advance notice of any change to your service plan or rates.

During the hours of 1:00 AM to 5:00 AM (local time) every day, Klick Networks may conduct maintenance, upgrades, firmware updates, and other necessary activities. Service may be interrupted during these hours without prior notice.

Klick Networks offers no guarantee regarding the accuracy, completeness, or utility of content provided by Klick Networks or third parties over the Klick Networks Service. Klick Networks is not responsible for the actions of any third parties contacted by Customer over the service.

Klick Networks will take reasonable efforts to safeguard personal Customer information. Klick Networks does not sell Customer information or share it with third parties except Klick Networks contractors when required for performance of their services. Klick Networks will only disclose Customer information to authorized officials or agencies as required by law.

Klick Networks may limit, suspend, or terminate Customer's service at any time without notice if the Customer fails to pay charges when due, if the service is being used fraudulently or for illegal purposes, or if Customer's use otherwise breaches this Agreement.

Klick Networks makes no representations or warranties as to the suitability of its service for any particular purpose. Klick Networks' sole liability for service disruption, regardless of cause, is limited to a credit proportional to the charges for the period of disruption.

To the extent permitted by applicable law, Klick Networks shall not be liable for consequential, incidental, special or other indirect damages, nor for economic loss, personal injury, or property damage sustained by Customer or any third parties. This section shall survive termination of this Agreement.

This Agreement and the documents to which it refers form the entire Agreement between Customer and Klick Networks. No failure or delay by Klick Networks in exercising any right or remedy shall operate as a waiver.

The invalidity or unenforceability of any provision of this Agreement shall not affect the validity or enforceability of any other provision, which shall remain in full force and effect.
