Terms of Service
Klick Networks, LLC
Effective Date: January 1, 2024
PLEASE READ THIS ENTIRE AGREEMENT CAREFULLY. This Agreement with you (the "Customer") consists of this document and the Service order (collectively, the "Agreement"). The Agreement defines our obligations to you, and your obligations in using the Service and the Equipment. This Agreement governs the entire relationship between Klick Networks, LLC ("Klick Networks" or "Klick-Net") and the Customer.
1. Acceptance
Customer has accepted and shall be bound by all the terms and conditions set forth in this Agreement by any of the following:
- Providing Klick Networks with a written or electronic signature on a service order.
- Verbally ordering service and accepting this Agreement if ordering by phone.
- Activating and/or using internet service through the Equipment.
- Paying a Klick Networks invoice.
- Utilizing the web portal for one-time or recurring credit card payment.
2. Fees
Checks returned for any reason will be subject to a returned check fee. In the event of collection activities for non-payment, the Customer may be liable for a 20% collection fee in addition to the original amount owed. Past-due invoices may be charged a late fee after the due date.
In the event Klick Networks must use legal means for collection of past due amounts, the Customer will be liable for all legal and filing fees when any award is in favor of Klick Networks, LLC. In the event any loss of service is found to be the fault of the Customer or Customer-owned Equipment, an hourly troubleshooting fee may be charged.
3. Term
The term of this Agreement is set forth on the service order and will be month-to-month unless otherwise indicated. This Agreement shall automatically renew on a month-to-month basis until terminated by either Klick Networks or Customer upon thirty (30) days prior written notice, an email to support@klicknetworks.com, or a ticket submitted via the Customer portal at portal.klicknetworks.com.
4. Installation
Customer warrants that they are at least 18 years of age and either own the premises or have received written permission from the owner to make any changes needed to install and receive the service. Customer authorizes Klick Networks or its contractor to install the Equipment necessary to receive the service and agrees to allow access to the premises.
The Equipment supplied by Klick Networks under this Agreement is and shall remain the exclusive property of Klick Networks and must be returned in good and working condition upon termination, expiration, or disconnection of service. Equipment not returned within 15 days may result in a charge of up to $900.
Site Conditions and Underground Utilities: Customer acknowledges that installation may involve digging and other activities that could disturb the ground. Klick Networks is not liable for accidental damage to subsurface structures including irrigation lines, unmarked power lines, sprinkler systems, or other buried features unless caused by gross negligence or willful misconduct. Customer is solely responsible for identifying and marking all underground utilities prior to installation.
5. De-installation
Upon cancellation, the Customer may opt to have a Klick Networks technician remove the Equipment, or the Customer may return it in proper working condition to the address on the most recent invoice. Equipment not returned within 15 days following cancellation may be repossessed or charged at replacement value.
6. Jurisdiction
This entire Agreement shall be governed by the laws of the State of Washington. The venue for any dispute shall be in a District Court for the Counties of service.
7. Payment
Customer agrees to pay for Service monthly in advance by pre-authorized automatic charge to a valid credit or debit card or ACH eCheck bank payment. All invoices shall be due upon receipt.
If Customer fails to pay an amount when due, Klick Networks may charge a late fee of 18% of the amount due. If Customer fails to pay by the due date, Klick Networks may suspend service without notice. Restarting suspended service requires payment of all amounts due plus a re-activation fee.
8. Acceptable Use
You must use the service in accordance with all federal, state, and local laws, ordinances, and regulations. Klick Networks strongly recommends protecting all devices connected to the Internet with firewalls and up-to-date virus protection software.
9. User Conduct and Prohibited Use
Customer may not use the service or Equipment for any unlawful purpose or in any manner that could damage, disable, overburden or impair the Klick Networks network. Prohibited activities include but are not limited to:
- Attempting to gain unauthorized access to data, accounts, servers, or networks.
- Interfering with service to any user, host, or network.
- Forging or falsifying TCP-IP packet headers or sender/recipient identity.
- Transmitting threatening, abusive, libelous, defamatory, or obscene content.
- Sending unsolicited bulk email (spam).
- Distributing viruses, malware, or other harmful software.
KLICK NETWORKS DISCLAIMS, TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALL WARRANTIES, REPRESENTATIONS OR OTHER ENDORSEMENTS, EXPRESS OR IMPLIED, INCLUDING ALL WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR USE. IN NO EVENT SHALL KLICK NETWORKS BE LIABLE FOR ANY SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES ASSOCIATED WITH OR ARISING FROM USE OF THIS SERVICE, INCLUDING ANY LOSS OF USE, DATA OR PROFITS.
10. Service Availability and Speed
Klick Networks fiber and wireless network is highly reliable and continuously monitored. However, extreme events outside of Klick Networks' control — such as lightning strikes and severe weather — can damage Equipment and affect service quality.
Klick Networks will provide thirty (30) days advance notice of any change to your service plan or rates.
11. Network Maintenance Hours
During the hours of 1:00 AM to 5:00 AM (local time) every day, Klick Networks may conduct maintenance, upgrades, firmware updates, and other necessary activities. Service may be interrupted during these hours without prior notice.
12. Content
Klick Networks offers no guarantee regarding the accuracy, completeness, or utility of content provided by Klick Networks or third parties over the Klick Networks Service. Klick Networks is not responsible for the actions of any third parties contacted by Customer over the service.
13. Privacy
Klick Networks will take reasonable efforts to safeguard personal Customer information. Klick Networks does not sell Customer information or share it with third parties except Klick Networks contractors when required for performance of their services. Klick Networks will only disclose Customer information to authorized officials or agencies as required by law.

14. Suspension or Termination of Service
Klick Networks may limit, suspend, or terminate Customer's service at any time without notice if the Customer fails to pay charges when due, if the service is being used fraudulently or for illegal purposes, or if Customer's use otherwise breaches this Agreement.
15. Limitation of Liability and Indemnification
Klick Networks makes no representations or warranties as to the suitability of its service for any particular purpose. Klick Networks' sole liability for service disruption, regardless of cause, is limited to a credit proportional to the charges for the period of disruption.
To the extent permitted by applicable law, Klick Networks shall not be liable for consequential, incidental, special or other indirect damages, nor for economic loss, personal injury, or property damage sustained by Customer or any third parties. This section shall survive termination of this Agreement.
16. General
This Agreement and the documents to which it refers form the entire Agreement between Customer and Klick Networks. No failure or delay by Klick Networks in exercising any right or remedy shall operate as a waiver.
17. Severability
The invalidity or unenforceability of any provision of this Agreement shall not affect the validity or enforceability of any other provision, which shall remain in full force and effect.
18. Changes to This Agreement
This agreement may be changed or updated at any time without prior notification. The most recent version may always be found on the Klick Networks website.
Acceptable Use Policy
Klick Networks, LLC
Klick Networks' goal is to provide its customers with the best high-speed fiber and wireless internet service possible. This Acceptable Use Policy (AUP) outlines acceptable use of the Klick Networks service and is in addition to any restrictions in the Terms of Service above.
Prohibited Uses and Activities
The following uses and activities are prohibited. You may not use the Service to:
- Undertake or accomplish any unlawful purpose, including posting or transmitting libelous, obscene, unlawful, or defamatory material.
- Transmit unsolicited bulk or commercial messages (spam).
- Impersonate any person or entity, or engage in sender address falsification.
- Access any other person's computer, system, or data without their knowledge and consent.
- Use or distribute tools designed to compromise security (crackers, password gatherers, packet sniffers, etc.).
- Use dedicated servers from your premises to provide services to anyone outside your local network (email hosting, web hosting, file sharing, proxy services, etc.) without prior permission from Klick Networks.
- Resell or share the Service with anyone outside your premises or use it to operate an internet service provider enterprise.
- Interfere with computer networking or telecommunications service to any user, host, or network (including denial-of-service attacks).
Customer Conduct
You are responsible for any use or misuse of the Service that violates this Policy, even if committed by a friend, family member, or guest with access to your account. You must maintain the confidentiality of your Service login and password and secure all devices you connect to the Service.
Network Management
Klick Networks manages its network to deliver the best possible broadband experience to all customers. Klick Networks uses various tools and techniques to manage its network, deliver the Service, and ensure compliance with this Policy. These tools are dynamic and may change frequently.
